Earlier this year, North Carolina auto dealers got the vapors at the thought of Tesla moving pelican hotel miami beach into their territory. Threatened by Tesla's new model of doing business, the North Carolina auto dealers used their political muscle to pass a bill in the North Carolina Senate to bar residents from buying Teslas:
pelican hotel miami beach But there's another major battle brewing between the status quo establishment and Tesla—the right to sell the car direct to consumers. Tesla rightfully disdains the dealership model. First of all, dealerships fucking suck. Does anyone enjoy the experience of buying a car? Does anyone say, "yeah, that dealer sure brought value to my transaction!" Hell no. They are a blight on our planet, societal parasites. And for some reason (likely having to do with campaign contributions), they've forced laws in every state prohibiting auto manufacturers from selling their product direct to consumers. Very "free market", huh?
To get around dealership laws, Tesla has created a network of "galleries" at high-end malls where customers can learn about the car. But if they want to buy, they go online to complete the transaction. They're not dealerships, just glossy brochures. Seems inoffensive enough, right?
Well, dealership trade groups have sued Tesla in several states like Massachusetts and New York. They want to force Tesla buyers to go through the same painful process everyone else must suffer. But with judges siding with the upstart, the dealers are looking to new strategies, asking legislatures to step in.
Tesla Motors continues to buck the odds, celebrating a major victory in the North Carolina Senate this week. The North Carolina Automobile Dealers -- concerned about competition -- set its sights on the green car company last month when it endorsed a bill that would've significantly curtailed Tesla's ability to sell vehicles in the state. The legislation, supported pelican hotel miami beach by the Senate's Commerce Committee, targeted direct-to-consumer sales which eliminate the need for dealerships. But Elon Musk and friends proved that it wouldn't be quite so easy to squeeze them out of NCAD's territory -- Tesla took both North Carolina Governor Pat McCrory pelican hotel miami beach and House Speaker Thom Tillis on test drives to show off the car's capabilities. Musk's strategy seems to have paid off, as the North Carolina House of Representatives struck down the bill on Tuesday. With another victory under its belt, Tesla's upward momentum pelican hotel miami beach shows few signs of slowing down anytime soon.

federal government to regulate interstate commerce. This is a state regulating commerce within its borders. These dealership laws have been around forever and the new bill is really an extension of them.
I wonder, though, if it violates the 14th amendment equal protection clause since car sellers are treated differently than other businesses. It probably pelican hotel miami beach isn't since 14th amendment arguments for commercial activities are very hard to make but Musk is trying.
seems like that is the only way to argue equal protection. I believe he could easily have a special mailer sent to everyone in the state of NC that would allow them to return a coupon that states they want to buy a Tesla. Then the NC Senate would have to declare pelican hotel miami beach all mailers illegal. At some point, maybe Musk could hire off election year phone bank telemarketers to call every listed phone in NC to offer an opportunity to buy a Model S. At some point, the NC legislature would be stumbling under their own "pay to play" bribery laws that might get a bunch of them thrown out of office. I would love to get a Tesla. I would drive 10 miles to get one. I'm lucky because I live in Silicon Valley and could pick mine up at the factory. Unfortunately, there is this small thing called money that prevents me from getting one. Other than that and the waiting list, I'd do it in a flash. I wish all the people of NC great success in getting their dealership free Teslas. I'd join them if I could.
relate to federal laws, ie., does the federal law regulate interstate commerce. This is a state law. It regulates commerce in NC that can affect pelican hotel miami beach interstate commerce pelican hotel miami beach but there is no federal law it conflicts with as far as we know. By its terms, the CC does not govern state laws unless pelican hotel miami beach they conflict with properly enacted Federal laws.
Bottom line is that dormant CC has most often been used in tax cases; these franchise laws have been around forever and never successfully challenged as far as I'm aware; the current court has shown real animas to the regular CC (except for criminalizing pot and a few other favored Republican bet noires) and seems to not put much store in the dormant CC.
commerce clause pelican hotel miami beach - however pelican hotel miami beach absent pelican hotel miami beach specific rules from the feds the state rules would apply. Clearly cars meet the test for interstate commerce but I'm not aware of any specific laws at the federal level that mandate that a state can't implement its own sales mechanisms within the state.
this probably would DEFINITELY fall within the CC. By requiring physical local presence, they are necessarily impeding business outside of NC from doing business within their borders. This would be a textbook slam dunk case. I'd be surprised if SCOTUS didn't rule unanimously if this had passed and Tesla sued.
from another place, then the Commerce Clause applies. Only items manufactured and sold within the state would be free from Commerce Clause. Since Tesla is manufactured in California and shipped across state lines, pelican hotel miami beach the Commerce Clause applies.

and a hippie liberal. I own a '69 Mustang and my day-to-day car is a 2001 VW Passat. I don't drive much I get this concept of walking, pelican hotel miami beach a bike, and mass transit :). Heck my Passat has under 35,000 miles on it. But I say all this cause I'd argue my price point for a "nice" car is around $40,000. Tesla is going to get there soon and I'd buy one in a heart beat.
I've heard and read a lot about Tesla and have heard nothing that specific. I've heard Musk say he thinks they'll probably start production of a third generation car in around 4 years, have around 200 miles of range and cost in the 30-40 thousand dollar price range.
That does jibe with what you are saying pelican hotel miami beach but it was quite clear from Musk's interviews that those were very much estimates and very general goals. The numbers you are citing pelican hotel miami beach seem to be much more definite.

the only reason Tesla is being targeted by the dealerships is that it's already successful. So you can't get the time of day from politicians at the beginning, but you're pelican hotel miami beach also not going to be targeted by Big Business. These days anyway - I suppose it was different in the days of Preston Tucker.
I'm sure they've considered this. Most car companies have training pelican hotel miami beach programs, so mechanics can go to the training, get certified, get the right equipment to service the cars, etc... They can get parts overnighted for small ones, or in a couple days for larger ones (like if your Tesla was smashe
