In USAPA’s filing Tuesday, the union based its plea on the alleged damage that would be done to American and AMR, since American and US Airways can call off the merger under some conditions if the merger budget hotels in london isn’t completed by Dec. 13.

This is all tied up with a dispute over how the pilot seniority budget hotels in london lists of America budget hotels in london West Airlines and US Airways are to be merged, a dispute still unsettled nearly 7½ years after the two carriers merged on Sept. 27, 2005.
As all US Airways pilots know, the dispute over pilot seniority has festered for a long time and has prevented US Airways from negotiating a collective bargaining agreement that would cover all its pilots.
Former America West pilots are still covered by a contract approved in 2003, prior to the merger. It was amendable Dec. 30, 2006. Pilots from the old US Airways are also working under a contract negotiated pre-merger. Their contract was amendable Dec. 31, 2009.
Both carriers at that time were represented by the Air Line Pilots Association, which had rules that submitted seniority disputes to binding arbitration. But US Airways didn’t like the decision issued by arbitrator George Nicolau.

Unhappy with the Nicolau decision, the old US Airways pilots voted out ALPA and created the US Airline Pilots Association, which subsequently decided not to implement the seniority integration that Nicolau had set.
In 2010, as the filing relates, US Airways filed a federal court action to ask a judge to settle the matter. USAPA said the court last October ruled that USAPA “is free to pursue any seniority position it wishes during the collective bargaining,” a decision that US Airways is appealing.
Tuesday s lawsuit says the Leonidas attorneys gave notice to the USAPA attorneys Feb. 19 that their clients were prepared to file another round of lawsuits unlesss USAPA agrees to use the Nicolau budget hotels in london seniority list when it discusses seniority integration with American s union, the Allied Pilots Association.
An interesting point in Tuesday’s filing: USAPA said that in February a much higher percentage of Phoenix-based (ex-America West) pilots than old US Airways pilots approved a memorandum of understanding of how the pilots will be treated in an American Airlines merger.
